The EB-3 (Green Card) Visa

The Employment-Based (EB) or Green Card Visa is the visa of choice for US RN sponsorship with Medliant. As a successful applicant, once you sign your contract with Medliant and meet all of the requirements needed to satisfy US Immigration, Medliant will begin the process of sponsoring you on this visa.

 

The EB Visa is intended for “skilled workers or professionals” who have at least a US Bachelor’s Degree in Nursing or foreign equivalent degree. In a previous Medliant blog post, the US CGFNS Visa Screen Certificate was discussed in detail. You may also go to CGFNS.org for more information. CGFNS is the accredited organization that will assess your education, nursing licensure, and NCLEX-RN exam results to ensure that you meet at least the equivalent of a US Bachelor Degree educated Registered Nurse. In order to satisfy US Immigration requirements and become sponsored on an EB Visa as an international Registered Nurse, you must hold a US CGFNS Visa Screen Certificate.

 

The Application Process

To become sponsored on an EB-3 Visa, your employer (Medliant International Healthcare Staffing) will file a Form I-140 (Immigrant Petition for Alien Worker) on your behalf as your petitioner.

 

Once your I-140 is approved, Medliant can then assist you in sponsoring your spouse and unmarried children (under the age of 21 years old) as dependents if applicable.

  

Visa Application Processing Timeframe

The US government has determined that there is a shortage of nurses in America, and has placed the nursing profession as a “Schedule A Occupation” which means that the processing time for I-140 petitions is faster than professions not listed in this category. You will still need to wait your turn in line, however, this will speed up the actual I-140 petition process.

 

From the time of initial application with Medliant, EB-3 Visa processing and approval, and when you finally arrive in the USA, the entire process can take as quickly as just 9-18 months. However, some countries may be backlogged and could take longer. US Immigrations frequently updates their priority dates for EB-3 Visa applications, as you will see below:

For example, applicants from the Philippines, Vietnam, Mexico, El Salvador and other countries not otherwise listed have priority dates posted as C or “current.” If your country is listed as “current” this means that there is no backlog or extended wait time for a green card application.

For the purposes of determining which country you will be classified from, it will be your birth country. The date that Medliant files for your petition will be your priority date.

Do I Qualify for an EB-2 or EB-1 Visa?

International Registered Nurses with a Bachelor Degree in Nursing would typically be sponsored on an EB-3 Visa which requires a Bachelor Degree. To qualify for an EB-2 Visa you would need to have an advanced degree (Masters or Doctoral) and for an EB-1 Visa you would need to have achieved exceptional accomplishments such as having been awarded a Nobel prize or to have been an Olympian, which is why the EB-3 is the visa is almost always the right choice for our Medliant applicants!

Can Medliant Recapture my Abandoned Petition?

Medliant can recapture abandoned petitions if you meet all application and US immigration requirements. This is why it is always important to maintain a copy of your petition.

 

How do I Prepare to Become a Medliant US RN?

To meet the requirements to become a Medliant US Registered Nurse you will need to:

 

  • Pass the NCLEX-RN Exam

  • Pass an English Assessment (Academic IELTS or TOEFL)

  • Hold a US CGFNS Visa Screen Certificate

  • Have 2 years of hospital experience by the time of starting employment in the US (Note: you may apply to Medliant with 1 year of current acute care experience in hospital with 100+ beds)

(Note: You can apply to Medliant even if you don’t have these documents, but do have at least 1 year of current acute care experience in a hospital with 100+ beds, however all of these requirements will need to have been met in order to be sponsored)
